3.1 Imposing and recommending resale prices
With regard to distribution, we must refrain from any joint action with competitors against 'price cutting retailers' who sell products below the recommended resale price or below the cost price
;Vertical agreements may be legally problematic if they lead to resale price maintenance, exclusivity, preferential treatment, parallel trade and category management.
While in many jurisdictions we can define a maximum price, we must not impose or even discuss a minimum or fixed price for distributors or retailers (referred to as 'resale price maintenance' - 'RPM' - or 'vertical price-fixing').
